End User License Agreement
Version 1.2 | Effective 2026 | EasyMarketResearch LLC
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and EasyMarketResearch LLC, operating as EasyCrosstabs ("Licensor"), for the use of EasyCrosstabs Analysis Platform ("Software"), including both the Free Edition and Pro Edition.
By checking the agreement box on the EasyCrosstabs welcome screen — whether accessing the Free Edition or activating a Pro Edition license — purchasing, downloading, or using the Software, you agree to be bound by the terms of this Agreement.
1. LICENSE GRANT
Subject to your compliance with this Agreement, Licensor grants you a limited, non-exclusive, non-transferable, revocable license as follows:
Free Edition
● Install and use the Software on your personal device for use by a single individual only.
● Access the features available under the Free Edition as defined at easycrosstabs.com.
● Use the Software for your own personal or internal business research purposes.
Pro Edition (requires valid license key)
● Install and use the Software on up to 5 personal devices that you own or control, for use by a single individual only.
● Access all features of the Software, including those exclusive to Pro Edition.
● Use the Software for your own personal or internal business research purposes.
● Create and export data visualizations and analyses using the Software for your personal or internal business use.
Each Pro Edition license key is issued to and valid for a single named individual. Team licenses consist of multiple individual license keys, each subject to the full terms of this Agreement.
2. LICENSE RESTRICTIONS
You may NOT:
● Redistribute, resell, rent, lease, or sublicense the Software.
● Share your Pro Edition license key with any other person.
● Use the Software on behalf of, or provide access to, any person other than the licensed individual, regardless of whether a license key is shared.
● Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Software.
● Remove, alter, or obscure any copyright, trademark, or proprietary notices.
● Use the Software to create a competing product or service.
● Share, publish, or distribute the Software file(s) in any form.
● Claim ownership of the Software or present it as your own work.
3. OWNERSHIP
The Software is licensed, not sold. Licensor retains all right, title, and interest in and to the Software, including all intellectual property rights. This Agreement does not grant you any rights to trademarks, service marks, or trade names of Licensor.
4. REFUNDS
This section applies to Pro Edition purchases only. Free Edition users have no purchase to refund.
Refund requests must be submitted within 14 days of purchase. Refunds are granted at the sole discretion of the Licensor. Upon refund approval:
● Your license key will be remotely deactivated by Licensor.
● You must immediately cease all use of the Software beyond Free Edition features.
● You must delete all copies of the Software in your possession.
5. UPDATES AND UPGRADES
● Updates (v1.x): Bug fixes, performance improvements, and minor UX enhancements to the current major version are provided to existing licensees at no additional charge, at Licensor's sole discretion.
● Major Upgrades (v2.0 and beyond): New major versions constituting substantial new functionality are separate products not included under this license. Licensor may, at its sole discretion, offer existing licensees preferential pricing on major version upgrades.
● Support: Technical support is provided on a best-effort basis via email. No guaranteed response time is provided.
6. DATA AND PRIVACY
● The Software operates entirely on your local device or browser.
● Licensor does not collect, store, or have access to your survey or research data processed through the Software.
● Free Edition users require no license validation. No data is transmitted to Licensor for Free Edition use beyond what is required to serve the application.
● Pro Edition license validation requires an internet connection and communicates with Licensor's licensing server (Cloudflare) and Gumroad's payment platform. A device fingerprint — a hashed value derived from technical characteristics of your device — is collected solely for the purpose of enforcing the device activation limit and is not used for any other purpose.
● No personal data beyond what is required for license verification is transmitted to Licensor.
7. DISCLAIMER OF WARRANTIES
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
● Warranties of merchantability.
● Fitness for a particular purpose.
● Non-infringement.
● Accuracy, reliability, or completeness of results.
Licensor does not warrant that the Software will be error-free, uninterrupted, or meet your specific requirements.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR:
● Any indirect, incidental, special, consequential, or punitive damages.
● Loss of profits, revenue, data, or use.
● Business interruption or loss of business opportunities.
This limitation applies regardless of the theory of liability (contract, tort, negligence, or otherwise), even if Licensor has been advised of the possibility of such damages.
Your sole remedy for dissatisfaction with the Software is to stop using it. Pro Edition users may additionally request a refund within the 14-day refund period.
9. TERMINATION
This Agreement is effective until terminated.
Automatic Termination: This Agreement terminates automatically if you:
● Violate any term of this Agreement.
● Request and receive a refund (Pro Edition only).
● Engage in unauthorized distribution or reverse engineering.
Effect of Termination: Upon termination, you must:
● Immediately cease all use of the Software.
● Delete all copies of the Software in your possession.
● Destroy any copies or distributions of the Software file(s) — this does not apply to research outputs, data exports, or analyses created using the Software.
Sections 3, 7, 8, and 10 survive termination.
10. GENERAL PROVISIONS
● Entire Agreement: This Agreement constitutes the entire agreement between you and Licensor regarding the Software and supersedes all prior agreements.
● Amendments: Licensor reserves the right to modify this Agreement at any time. For material changes, Licensor will make reasonable efforts to notify users via the website (easycrosstabs.com) or email. Each version of this Agreement is identified by a version number. Your license key records the version in effect at the time of activation.
● Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full effect.
● Governing Law: This Agreement shall be governed by the laws of the State of Texas, without regard to conflict of law principles.
● No Waiver: Failure by Licensor to enforce any provision of this Agreement shall not constitute a waiver of that provision.
